Enforcement of international settlements agreements under the singapore convention –A comparative study in Turkish & the EU law

The United Nations Convention on International Settlement Agreements Resulting from Mediation (the Singapore Convention), as its very name signifies, aims to create an effective mechanism for enforcement of mediated settlement agreements. The Singapore Convention has been ratified by Türkiye; thus, our country has become the eighth State Party to the Convention which has officially entered into force on 11 April 2022. On the other hand, despite the EU's active involvement in the treaty negotiations, neither the EU nor its Member States have not yet signed the Convention. Türkiye and the EU have very strong economic and commercial relations. Hence, there are and will be many commercial disputes settled without going to court. Therefore, this thesis aims to evaluate the Singapore Convention by considering Turkish and European Union Law. Mediation, as an Alternative Dispute Resolution (ADR) method, is worthy of attention, as it is associated mostly with international commercial affairs. As a newly in-force convention, the Singapore Convention not only brings novelties to the existing international dispute resolution dynamics, but also aims to change these dynamics totally. Hence, it can be argued that it would be affecting both signatory states and non-signatory states. Although arbitration and mediation areas have been brought together many times before, prior studies mostly do not consider the recent developments in the context of the evolving economic atmosphere and legal framework under the COVID19 circumstances. This extensive study aims to undertake a critical examination of Singapore Convention in cross-border disputes. Keywords: Singapore Convention, Mediation, Alternative Dispute Resolution, Arbitration.
