Abstract (EN)

The issue of companies being rights subjects in Human Rights Law corresponds to a controversial area. Considering its historical foundations, this branch of law, which prioritizes protecting the dignity of the individual, now provides various protections for companies, prompting practitioners and theorists to think about it. As companies claim that their fundamental rights and freedoms have been violated through individual applications, this creates some procedural problems for companies and makes it necessary to determine the catalog of protected rights of companies. At this point, the purpose of this study is to discuss what the fundamental rights and freedoms of companies are protected in positive law within the scope of the jurisprudence of the European Court of Human Rights and the Turkish Constitutional Court.
