Abstract (EN)

Under enforcement and bankruptcy law, the liquidation of assets and rights that constitute the subject of debt enforcement proceedings constitutes the stage where the objective of the proceeding is realized. The liquidation stage may exhibit certain differences according to certain properties of the assets or rights that constitute the subject of the proceedings, under substantial law pertinent to those. This research consists of three chapters. Under the first chapter, civilian aircraft that may be pursued through debt enforcement proceedings and the security interests thereto have been generally examined. The substantial legal properties that show importance in the determination of the relevant procedure of enforcement pertinent to the civilian aircraft securities that constitute the subject of proceedings have been treated, and unmanned aerial vehicles that might be the topic of a separate research have been excluded. In the second chapter, the procedure of enforcement proceedings that will be carried out once civilian aircraft constitutes the subject of debt enforcement proceedings and the procedures of liquidation have been examined thoroughly. In the third and final chapter, the amendments made to the Enforcement and Bankruptcy Law in the purview of Cape Town Convention.
