Abstract (EN)

The thesis of "Bad Faith In Trademark Registration and It's Legal Consequences within Industrial Property Law" studies the term of bad faith within the scope of the rule of good faith under national and international regulations. Since the scope and examples of bad faith in trademark registration aren't regulated by any law, doctrine and high court decisions and foreign judgments are utilized. It's one step further by application in bad faith has been accepted as a cause for refusal and invalidation within Industrial Property Law by Decree-Law No. 556. Considering bad faith in trademark registration as a cause for refusal and invalidation like in many EU countries and China, would be more effective role in a bad faith in trademark registration.
