Abstract (EN)
This thesis aims to explore the concept of "series marks" as mentioned in the Industrial Property Law, examining the definability conditions of this type of mark and offering a new perspective on trademark law. While outlining the general framework of trademark law, it extensively discusses the elements to be considered in the process of creating series marks. Emphasizing the definability conditions set by the Court of Cassation and the European Court of Justice, it evaluates aspects such as the justification of using the root mark, the obligation of the source mark to carry the essential element, and the intention of the new mark to create a series mark from a legal perspective. The thesis, illuminated by these analyses, aims to highlight the advantages that series marks provide to businesses and underline the potential role of this type of mark in future trademark strategies, making a significant contribution to trademark law.
