Elderly care in social security law

Social security has been one of the most rapidly developing areas among social policy instruments between the two World Wars and after the Second World War. Countries have started to discuss and regulate social protection measures more seriously against social risks that are becoming increasingly significant and various in human life. Nowadays, in addition to the traditional social risks that social security provides protection, it should be discussed to provide protection by social security instruments against the risk of care dependency in old age, arises due to the living conditions of the elderly, which are classified within the new social risks. Based on this need, our study analyses elderly care in social security law. Due to the demographic transformation in our country, the ageing population needs to be effectively protected against the social risks that it may face. Because of the ageing of the population and the changes in the lifestyle of the elderly, the care dependency for the elderly is increasing. For many years, the care needs of the elderly have been seen as the responsibility of families and social institutions, but in recent years, it has become an area states have to assume more responsibility. The effect of the demographic transformation due to the age-related increase in the care dependency in Turkey is also being felt significantly in our country. In Turkey, the care of the elderly and disabled in care dependency has been undertaken by their families until now, and the family has become the cause of collective escape from social responsibility. Nevertheless, the care depencency is seen as a problem of the family, is a problem to be solved by the society. The fact that social assistance and services in the non-contributory regime adopted in our country regarding elderly care do not ensure protection against the risk of the elderly being in need of care deepens the problem of the elderly who cannot be cared for within the family. The available assistance and services are aimed at sheltering and sustaining the lives of the 'economically poor' elderly and do not address the care needs of all elderly people in care dependency. Social assistance and services provided for care in our country are inadequate in terms of the amount, the way the assistance is provided and the conditions for entitlement to benefits. In this context, the main purpose of this study is to determine an effective protection model against the need for care through social insurance, i.e. care insurance, in addition to the social security system without social contributions.
