Abstract (EN)

The concept of social media has started to take an important place in our lives by continuing to change and develop day by day. With the development of the internet and technological opportunities, the communication and interaction of people with each other increases in parallel and at the same speed. This situation has necessitated to deal with the legal dimensions of social media and the problems it brings, as in all areas of life. The crime of insult, which is among the most committed crimes on the Internet and especially in social media, has begun to take shape according to the changing expression cultures of individuals within the framework of the concept of criticism. This situation has led to many question marks about how the crime of insult is committed on social media and the punishability of the crime. Considering that freedom of expression is of great importance within the framework of human rights, while keeping pace with the changing world, the rights of individuals should be protected on the one hand, and the limits of expressions that cause crime should be tried to be drawn on the other. In this study, the general characteristics of the crime of insult were specified, compared with similar crimes, the general characteristics of the freedom of expression, its limitation and its appearance in social media were expressed, the characteristics and limits of the right to criticize were tried to be determined. committing the crime of defamation, the characteristics of social media applications, sharing principles and criminal liability of users against crime and the problem of proving these crimes are examined.
