Abstract (EN)
Lately, the use of social media has been increased with the development of technology. Social media has now become a means of communication, a source of income, and an environment for socialization. Due to the increase in the use of social media and content sharing such as personal photos, videos, audio and information, unexpected attacks have begun to occur against personal rights. Attacks made through social media not only constitute a crime but also cause tortious acts. Since attacks against individuals via social media lead to violations of personal rights, individuals will be able to apply for legal protection in accordance with the provisions of the Turkish Civil Code on the protection of personal rights. In addition, in order to provide a more effective way of protection in violations of personal rights through social media, a framework of special provisions within the Law No.5651 on the Regulation of Broadcasts on the Internet and Combating Crimes Committed Through These Broadcasts has been established. Personal right violations that are done on social media and social media platforms and way to appeal against these violations are very important because it is a current issue. For this reason, the Law No. 5651 amending the Law on Arranging Broadcasts Made on the Internet and Combating Crimes Committed Through These Broadcasts was accepted by the Parliament on July 29th, 2020 and published in the Official Gazette on July 31st, 2020. With this regulation, many fundamental changes have been made which has been on the agenda for a long time and is known as the social media law in the society. In study, the values that constitute the subject of personal rights, social media and its subjects, and legal protection ways that can be applied within the scope of the Turkish Civil Code and Law No.5651 has been examined.
