Özet (EN)

The thesis which is named as ?crime of buying or taking of goods derived from crime? has been carried out by using only Turkish bibliography. This thesis consists of two sections.In the first section there are general explanations about offences against property, since the crime ?the subject of this thesis? constitutes one of these offences. The term property and offences against property are explained and the different views in the literature on the legal values which are protected by this crime have been analyzed. The term goods derived from crime has been elaborated, by also taking into account of the term of property in civil law. The following have been scrutinized: the legal values protected, the elements of the crime, the specificities of the crime, the personal reasons of impunity, the personal reasons which require a reduction in the penalty, prosecution and sanction. There are also explanations of ?prerequisite?, since some authors in the doctrine acknowledge the existence of a prior crime as a prerequisite. The necessity of the determination of a prior crime has been discussed under the heading of ?prosecution?.In the second section, besides, the characteristics of the goods which are derived from a crime have been settled. The problem of acquisition of property in the case of buying goods which are derived from a crime has been assessed within the context of the terms good faith and property. Lastly, the relationship of the crime of buying or taking of goods derived from crime and other relevant crimes have been examined.This thesis includes the Court decisions related to the crime ?the subject of this thesis? which is common in practice. The controversial subjects have been examined in conjunction with the Court decisions and some conclusions have been reached.
