Abstract (EN)

Criminal organization groups can be defined as a structures consisting of at least three people, connected by hierarchical relationships, established with the purpose of continuously committing numerous crimes. The act of forming an organization fort he purpose of committing crimes has been present throughout history and is encountered today not only at the national level, but also at the international level. Crime organizations create panic, fear and anxiety in society by employing intimidation tactics and establish organized networks at an international level thanks toadvancing technology. Therfore, crime organizations carry the concrete danger crime natüre that jeopardizes public order and security. The fight againts organized crime and crime organizations must be conducted through legal means not only at the national level but also at the international level. In this context, various regulations are present in both Turkish Law and international law, which are discussed in our study. The Turkish Penal Code Article 220 regulates the crime of establishing an organization fort he purpose of committing crimes as a concrete danger crime and an independent crime. The relevant article provides criminal sanctions fort he perpetrators who establish, manage, join, commit crimes on behalf of the organization without being a member, assist the organization and engage in the organization's propaganda. In this study, the elements of the organization, regulations in other countries, international regulations, TCK article 220 provisions and the effective remorse process are examined detail.
