Abstract (EN)
The rule of law refers to the state in which the competent organs of the state comply with the requirements of law vis-à-vis society, and then the judicial mechanism of the state works effectively and there is no room for arbitrariness. The rule of law, among many other features, will become possible when the rules of law are certain, that is, accessible and predictable. The rules of criminal law must be more specific and mandatory due to the interference of human freedom. The necessity of specifying crime and penalties is also the result of the principle of law in crime and punishment, which is a fundamental principle adopted by international and national law. In the study, criminal policy and criminal law principles will be examined and as a result of these investigations will be assessed on the charge of "giving or taking data against the law". Although assessments are conducted in this crime-specific way, they are essentially to cover other crimes related to personal data. The examination of crime policy and criminal law principles will be useful not only in terms of the crime of "unlawfully giving or obtaining data", which is the main subject of examination of the study, but also in terms of the existing and future crimes and penalties.
