Abstract (EN)

With the completion of the formation of fiqh, different sub-writing types have emerged as a result of the jurisprudence of the two main parts of fiqh, usûl and furu ,such as kavâid, fürûk, Eşbâh and nezâir, muhtasar, mazûme, şerh, haşiye and fatwa. Esbâh and nezâir literature, which are among these sub-literary genres that emerged as a result of the studies of jurists, show the dynamic structure of fiqh. However, it can be stated that providing convenience in reaching the provisions and systematizes the similarities and differences between the fer'i issues provides convenience for the teacher and the student. In this study, the work of Tacüddin es-Sübkî (d. 771/1370), named el-Eşbâh ve'n-Nezâir, who has a deep knowledge in terms of kavâid literature in general and el-Eşbah ve'n-Nezâir literature in particular, has been studied. Having a wide acquis in many fields such as history, literature, hadith, syntax, etc., Subki is especially competent in the field of fiqh and methodology. This study consists of two main sections, which in the first section Subki's life is discussed. In this context, with the title of "Subki's life", brief information is given about his lineage, birth, family, and the political, social and cultural structure of the period in which he lived. Then, brief information is presented about Subki's educational life, teachers, students and works. In the second part, the theoretical and practical background of the eshbah and nezâir literature, which is the main subject of our study, and Subki's work al-Eşbah ve'n-Nezâir are discussed and examined in terms of content and method. The rules, which are listed in terms of importance and scope, and theological, procedural, lexical and miscellaneous issues affecting the jurisprudence have been studied. In terms of some important views, it is compared with the other works in those subjects in various aspects to show the interaction between them.
