Protection of real estate possession against trespassing administratively

Topic of our thesis is protection of real estate possession against trespassing administratively. According to one opinion being a right, according to another opinion being an actual situation, according to the third opinion; which we have also participated being a legal status, protection of possession constitutes an important place in our law. As mentioned in previous sections ^protection of possession administratively, is a procedure that have been based on the far past, pre-republic period, according to Turkish Law. In accordance with these points, our thesis consists of two main sections which follows the introduction and a conclusion.In the introduction of the thesis, in order to assist the comprehension of the importance of the topic better , a detailed history of protection of possession administratively and a comparision of the Law No.3091 with the Law No. 5971 have been included. In the first section, basic legal concepts related to topic (real estate and possession) have been mentioned. After having mentioned the subject and the varieties of real estate, the concept of possession have been emphasized in detail, all the fundamental viewpoints related to the controversial points in doctrine have been referred and in the end, our own opinions have also been reported. The second part of the study has been titled as "protection of real estate possession against intervention and trespassing?. In the mentioned section ,the concepts of trespassing and intervention have been explained ,afterwards application investigation judgement, application against judgement, execution ,second and proceeding intervention and trespassing , penal provisions and various verdicts related to practice have been included according to the Law No .3091. If required, by avoiding to impair the integrity of the study, we have mentioned the interpretions of judgement about the subject.In the conclusion part of the thesis the subject has been generally evaluated and our suggestions for the improvement of deficiencies and errors in practice have been shortly emphasized.
