Abstract (EN)
Medical researches are very important for the cure of sickness and for the development of medecine. But medical researches have to respect some rules of ethics in order to protect human life and human dignitiy. Actually these principles of ethic, are transformed into rules of the law. The Convention on Human Rights and Biomedecine is one of the most important treaties which arrange medical researches. In Turkish law also, a new norm is adopted concerning medical researhes. According to international principles of ethics and to the convention on human rights and biomedecine, the new turkish penal code determined the conditions of medical research. However, the article which determine the conditions of medical researches has some deficiencies. So, there must be an harmonisation between Turkish Penal Code and the said Convention to ensure an efficent protection.
