Abstract (EN)
Aim: Our aim in our study is to determine the place of informed consent in medical intervention and to examine its scope and to reveal its importance in the field of health in the light of Supreme Court decisions. Material and Method: Ten of the decisions made on the patient's consent to medical intervention were examined and various subjects were mentioned in tabular form. Results: Ten of the Supreme Court decisions were examined and the importance of obtaining consent in these decisions was emphasized. In the decisions, it was not found correct that the local court made an incomplete examination without considering the issues of clarification and thus obtaining consent, and the court decisions were overturned. In some of the cases examined, although the patient's consent was obtained, it is seen that this is the consent obtained without informing the patient about the medical intervention and constitutes a violation of the law. Conclusion: The issue of consent has an important position in medical law. Obtaining the patient's consent is only possible by clarification of the patient's subject, outcome, treatment stages, and recovery process. Although the forms that exist in the form of "informed consent form" in practice are important in terms of proving informing the patient, they are not considered as a full disclosure. Clarification forms should be prepared after detailed verbal clarification and presented to the patient's approval, taking into account the effects of the medical intervention on the person, the process and outcome of the treatment.
