Economic life plays a very important role in social life. Economic life is expected to operate legally, but from time to time illegal activities also take place in economic life. These activities are sometimes punished by means of administrative law; however they sometimes face the sanctions of criminal law.Bankruptcy crimes are one of these crimes that are commited to obtain more money or economical power. Bankruptcy crimes are actually fraudulent legal transactions that reduce the activa. Apart from these transactions, a negligent businessman can also be liable by the result of negligent bankruptcy.In Turkish Law, bankruptcy crimes were first regulated in Code on Enforecement and Bankruptcy. In 2005 with the enactment of Turkis Criminal Code nr. 5237, these crimes were regulated under the new code. There are two bankruptcy crimes in the Turkish Criminal Code: Fraudulent Bankrptcy and Negligent Bankruptcy. In this thesis elements of benkruptcy crimes are first discussed and the possible effects of the new regulation are tried to be determined by means of comperative law.
