Crimes of thretening or insulting chants and disparaging community groups in sports venues

Sport is a set of activities, dating back to ancient times, that significantly contribute to both physical and mental development. In its nature, sport encompasses enthusiasm, excitement, a sense of adrenaline, and the spirit of fair play. It interacts with various cultural, social, economic, and political elements. In this sense, it serves as a microcosm that reflects life itself. Just as in life, within the realm of sport, there are also actions that overshadow its positive aspects—such as violence, disorder, and unruly behavior—which threaten public order and prevent individuals from accessing sports in a safe environment. As is the case in many parts of the world, sport is highly cherished and closely followed with enthusiasm in Turkey. However, the growth of the sports industry has made it essential to establish legal regulations to ensure its governance and to prevent violent acts. With the enactment of Law No. 6222 on the Prevention of Violence and Disorder in Sports in 2011, the aim has been to prevent crimes that cause violence and disorder in sports venues and to ensure the safety of these venues. Article 14 of Law No. 6222 regulates the offenses of chanting that includes threats or insults, and of disparaging community groups in sports venues. This study consists of three parts. In the first part, in order to better explain the offenses regulated under Law No. 6222 and the underlying causes of these offenses, concepts such as violence, disorder, and hooliganism are defined, along with an analysis of the factors that lead to violent and aggressive behavior in sports environments. In addition, the historical development, legal background, and effectiveness of national legislation and international agreements to which Turkey is a party are assessed within the scope of efforts to prevent such acts. The second part of the study provides a comprehensive examination of the offense of chanting that includes threats or insults, as regulated in Article 14(1) of Law No. 6222. Furthermore, since verbal and behavioral acts occurring in sports venues may constitute different types of crimes under the Turkish Penal Code depending on the circumstances, other related offenses are also addressed. This section also aims to clearly explain the legal process and the sanctions applied when such offenses are committed. In the final part of the study, the offense of disparaging community groups in sports venues, regulated in Article 14(2) of Law No. 6222, is analyzed in detail, along with other similar offenses.
