Abstract (EN)

Any news or criticism received through television may violate the personality values ​​of a person, and this violation may have a negative effect on the right to personality. In such a case, the right of person, the person who is infringed TMK m. 24, the judge should be protected from the attackers, in particular the TMK. 25/3, he may demand compensation for his own non-pecuniary damage. Similarly, the Turkish Code of Obligations provides that the compensation for the moral hazard suffered by or in the event of bodily harm or death of its immediate family members is subject to the special provisions of the TBK. 56, the right to receive non-pecuniary compensation arising from a breach of personality is also subject to the provisions of the TBK. Protected by 58. . A case of non-pecuniary damage arising from a violation of personality through television; A violation of the moral hazard arising from the violation of the personality rights of a natural or legal person through television. The subject of my thesis is the case of non-pecuniary compensation arising from the infringement of personality rights through television. This topic has been studied in three parts. In the first chapter, concepts of person, personality, personality right are defined and the subject and characteristics of personality right are explained. In the second part, general information about television concept is given, and the place of television broadcasts in social life, television broadcasts and television broadcast service principles and restrictions on television broadcasts are examined. In addition to these, the conditions of violation of personality right through television, the reasons for compliance with the law, and the violation of personality right through television are explained. In the last section, the case of non-pecuniary damage arising from press freedom, freedom of communication and violation of personality rights via television has been discussed in detail.
