The assignment of receivables for security purposes is a type of security that is frequently preferred in Swiss and Turkish banking practice and is a mixed fiduciary transaction. As with all fiduciary transactions, the legislator has not regulated this type of security. However, today, both in the doctrine and case law, there is no doubt that fiduciary transactions can be validly executed, and in this context, the assignment of receivables for security purposes can also be validly established. In this study, the assignment of receivables for security purposes is analyzed in three main sections. In the first part, in order to provide a general introduction of the subject, the characteristics of this type of security, its differences from similar concepts and assignment of receivables for security purposes in comparative law are touched on. In the second part, the structure of the assignment of receivables for security purposes is examined and the security (fiduciary) agreement as promissory transaction and the assignment of receivables contract as dispositive transaction are analyzed separately.The last section includes the rights and obligations of the parties arising from this legal relationship.
