Abstract (EN)

This study tries to present assessments and solutions of the terms 'terror' and 'terrorism', which change fast via globalization and became an asymmetric power in the interstate struggle, by scrutinizing ina legal perspective. The aim of the study is to scrutinize the imposing sanctions lawfully in a common platform according to a framework decisionafter setting a definitionwith the reasons why the terrorism could not be defined in a legal perspective in the context of the history of terror. In the first chapter of the study,terror's being as old as the history of humankind, the problems emerged as a result of its universality evolving in years, scrutinizing the problem of definition, which is the leading problem, in a legal and doctrinal way will be began. Afterwards, the diversity of the topic will be examined with regards to the reasons of the terrorism. While looking for answers to the question for what reasons the terror is committed, the new perception of terrorism after its mutation in the international arena is discussed. In the second chapter,the topic of the how agedness is the globalization, which is the primary factor in expanding the terror events, will be taken in a doctrinal approach. Whether the globalization serves for development for the other countries or hegemony over them, how the hegemony set after this process causes global terrorism and what instruments it accomplishes this will be examined. In the third chapter, the legal cooperation in the fight against terrorism will be emphasized by making legal examination in the international fight against terrorism and the points where the international law fails.
