Crime of revealing the information or documents included in commercial secret, banking secret or costumer secret (TCL t. 239) constitutes the subject of the thesis. In spite of the fact that it was taking part, earlier, in the 765 numbered Turkish Criminal Law, with 5237 numbered law, more detailed and more specific arrangments concerning the quality of the secret has been come.In spite of the importance of the crime, its practice has been so care until today. Not want the more people get known the revealed secret by the way of complaining, long lasting criminal trails or proof difficulties may be reasons of this. But it is estimated that with the arrangements made in the Banking Law and at the present time with the law draf concerning commercial secret, banking secret and costumer secret, in today?s society which is on the way of being an information society, commiting revealing the secret and crime will gain momentum.In our study, under general statements title first concept of secret is tried to be explained and its constitutional position evaluated. After mentioning the arrangments that protecting the secret concept, the secret concept is studied in international dimension. After examining legal value protecting with crime, materials elements of crime, crime?s anti-law elements and crimes moral elements under the title of elements of crime, it is mentioned important points fort he special types of crime, trial law problems concerning the sanction and crime are referred.
