Abstract (EN)

Thousands of traffic accidents occur in our country every year and thousands of people die or suffer material and moral damage in these accidents. Therefore, the damages caused by traffic accidents emerge as a matter of concern to many people such as the injured or deceased person, as well as their spouse, children, parents, etc. In these cases, the person who suffered a loss has the right to file a claim for compensation in accordance with Article 49 of the Code of Obligations in order to compensate financial and moral damages suffered by the heirs in case of death. Compensation arising from traffic accidents is requested from the person who caused the traffic accident. However, this issue; The shape of the accident, the condition of the defect are evaluated differently in each case. In this study, we will examine financial and moral compensation in traffic accidents, which is frequently encountered in the legal literature, which has many and complex aspects. In the first part, insurance contracts and types in general; In the second part, traffic accidents and legal responsibility issues are discussed. In the last part, financial and moral compensation cases in traffic accidents within the scope of compulsory traffic insurance, which is the main subject of the study, are evaluated within the framework of the local court and the Supreme Court case law.
