In traffic accident the legal responsibility of motor vehicle operation

The matter of this study, to examine Highway Traffic Law of Motor Vehicle Operator's Civil Liability in terms of Turkish Code of Obligations and Supreme Court decisions. This responsibility which who operates the vehicle is a strict liability. Strict liability has emerged in many areas In the face of technological advances and bring era as structure of motor vehicle. It has emerged due to the danger element in the structure and in this regard legislator has adopted strict liability basis. This study is related to the legal responsibility which it emerged for due to the damage caused by the operation of motor vehicles. In our study, damage of legal responsibility because of the operation of motor vehicles has examined under the headings of Application Areas of Road Traffic Law, The Concept Vehicle Operating, Car Operator's Responsibility and Conditions, Damage, Compesantion and Overview of Responsibilities in frame of systematic of Road Traffic Law. The subject of study is dispute which often encountered in daily life, causing conflict between members and thus located in court. Because of the subject is topical and throuh life, aimed to give information about transformed state of study with Supreme Court Decisions.
