Abstract (EN)

This study focuses on the World Trade Organization (WTO), which was founded under the leadership of the United States after World War II and is one of the most important international organizations in maintaining global economic hegemony, and the TRIPS Agreement, one of its most important agreements. In order to better understand the purpose and functions of the WTO, both the transformation of the concept of trade in the recent historical process and the consequences of the WTO's activities for countries at different levels of development in the international conjuncture are examined. In order to better understand the principles of the TRIPS Agreement, which introduces regulations in the field of Trade-Related Intellectual Property Rights and is binding for all WTO member countries, and what kind of results it leads to, the birth of the concept of intellectual property and the transformation it has undergone in the historical process have been examined comprehensively. As a result of this comprehensive examination and evaluations, it has been seen that the regulations brought by the WTO, which wants to liberalize trade by removing the barriers to world trade on an international scale and thus claims to have the mission of increasing the welfare level of all countries, have created a system that creates benefits in favor of developed countries rather than a fair resource sharing. It is tried to prove that this is not an accident but the result of a conscious and systematic approach by revealing the developments over the years. At the end of the study, the results of the liberalization policy of developing and underdeveloped countries, and the consequences of the policy of increasing their welfare level by this means, have been revealed with a number of statistics. It has been argued that this outdated promise of the US-hegemonic WTO should not be taken into account, especially by developing countries. As a matter of fact, it has been tried to show that it is possible for countries to develop reasonable new paths that they can follow in international trade, taking into account their own political economy status, with the example that countries that follow a more selective foreign trade policy with rational policies instead of unconditionally adopting an uncontrolled free market economy have achieved a better economic outlook.
