Impact of Law on Consumer Protection on insurance contracts

Abstract (EN)

Policyholders benefit from the protective provisions of the insurance legislation by being a party to insurance contracts. In case policyholders carry the title of consumer, it is necessary to consider the possibility of applying the consumer legislation. With our study titled "Impact of Law on Consumer Protection on Insurance Contracts"; it is aimed to determine the applicability of the Law No. 6502 to insurance contracts in the nature of consumer transactions and which articles of the Law are to be applied to these contracts. The first chapter of our study, which consists of three chapters, examines whether it is possible to apply the Consumer Law to insurance contracts. In the second chapter, which consists of examining the provisions in the Consumer Law applicable to insurance contracts in the context of insurance law, articles 4, 5, 6/2, 13 and 17 of the Law are explained in comparison with the relevant regulations in the insurance legislation. In the third chapter of our thesis, insurance regarding a credit and the building completion insurance are examined, which constitute explicit provisions on insurance contracts in the Consumer Law.
