Abstract (EN)
Liberty has been one of the most predominant subject on which humanity has given consideration over the ages. With the advance of more societal life, satisfying the people's need for security has brought a new debate that is about the restrictions on liberty which are likely to ensue once providing security. In this study, we will elaborate on methods that allow minimum constrains and maximum liberty while providing essential security for both individual and society. For this purpose, we will try to equate freedom for individual with security for society in respect to the principles of international law by preferring the constitutional law, as the top of normative hierarchy, that ensures fundamental rights and freedoms for individual.
