Abstract (EN)
In the first chapter of this thesis, online intermediation service providers, who, based on their contractual relationships with business users, facilitate the practice of the economic activity thereof in the internet environment, are defined. Characterization of online intermediation service providers as commercial agents in Turkish and EU law is assessed by subsumption and comparison methods in the second and third chapters respectively. Issues that consist our thesis topic are identification of online intermediaries and their conceptual framework, arguing necessity for regulation in Turkish law and finding the legal correspondence of the relationship between online intermediaries and businesses in the existing agency law. These issues are resolved according to the provisions set out under Commercial Agency Section of the Turkish Commercial Code, Regulation (EU) 2019/1150, Council Directive 86/653/EEC and the decisions of courts and competition authorities that can be used as a tool to interpret those provisions.
