The crime of unautorised access to computer system in Turkish criminal law

The subject of this study is the crime of unautorised access to computer system regulated in Article 243 of the Turkish Crime Code. n the study, first of all, the definition of the concept of cybercrime and the technical terms related to cybercrime, and the classifications made regarding this concept were examined. Then, the historical development of cyber crimes in the world and in our country and the regulations in the Council of Europe Cybercrime Convention were mentioned. In the following sections, the crime of unautorised access to computer system was examined in light of the regulation in Article 243 of the Turkish Crime Code. In this context, firstly, the legal value protected by crime was mentioned. Then, the material element of the crime, the moral element and the element of illegality, and the quality of the crime and its aggravated state due to its result were examined. Next, the crime of unautorised access to computer system was examined in terms of participation and combination of crimes. Finally, the trial procedure and the sanctions stipulated in the law for the crime examined are emphasized. Le sujet de cette étude est le délit d'accès non autorisé au système informatique réglementé par l'article 243 du code pénal turc. ans l'étude, tout d'abord, la définition du concept de cybercriminalité et des termes techniques liés à la cybercriminalité, ainsi que les classifications faites concernant ce concept ont été examinées. Ensuite, l'évolution historique de la cybercriminalité dans le monde et dans notre pays et les réglementations de la Convention du Conseil de l'Europe sur la cybercriminalité ont été évoquées. Dans les sections suivantes, le crime d'accès non autorisé au système informatique a été examiné à la lumière de la réglementation de l'article 243 du Code pénal turc. Dans ce contexte, premièrement, la valeur juridique protégée par le crime a été mentionnée. Ensuite, l'élément matériel du crime, l'élément moral et l'élément d'illégalité, ainsi que la qualité du crime et son état aggravé en raison de son résultat ont été examinés. Ensuite, le crime d'accès non autorisé au système informatique a été examiné en termes de participation et de combinaison de crimes. Enfin, la procédure de jugement et les sanctions prévues par la loi pour le crime examiné sont soulignées.
