Previntion of public duty in Turkish Criminal Law

Due to the increased involvement of the state in societal life and its activities, crimes against public activities have also risen. In order to ensure the common interests of society and the proper execution of public activities, the legislator introduced the offense of resisting the performance of duties in Article 265 of the Turkish Penal Code no. 5237. This crime, which goes against the reliability and functioning of public administration, was regulated in a specific article under Law No. 5237, unlike the repealed Law No. 765, bringing an end to disarray. In our study, necessary evaluations regarding the elements of the offense of resisting the performance of duties in TPC Article 265 have been made, and different opinions in doctrine have been addressed. Alongside theoretical information, our study includes both theoretical and practical evaluations by frequently utilizing precedents from the Court of Cassation.
