Abstract (EN)
The present dissertation discusses the history and philosophy of "mens rea", and provides an explanation of the current regulation of mens rea in Turkish Criminal Law, including the many theoretical disputes surrounding the subject. Mens rea is one of the founding elements of crime, it is an acknowledged principle in criminal law no act will constitute a crime unless mens rea is present. This study examines with detail the main states of mens rea which are intent and negligence, discusses the regulations of objective responsibility still present in Turkish Criminal Law in our opinion, and explains legal defenses pertaining to the absence of mens rea.
