The imposition of the report obligation for healthcare professionals has been included in the regulations introduced for many years in order to protect the public interest and to ensure the legal necessity by the legislators in Turkish criminal law and comparative criminal law. The crime of not informing crime for the members of the health profession is regulated in Turkish law under article 530 of the former Turkish Penal Code No. 765 and article 280 of the new TCK. In Turkish Criminal Law, the crime of not informing crime for the members of health profession, the differences between the Turkish Penal Code No. 765 and Turkish Penal Code No. 5237 are examined in detail by comparing each other. Being brought report obligation for healthcare professionals brought along some criticisms. By emphasizing the aim of the legislator to bring the regilation, discussions and disagreements about whether it is necessary to being brought report obligation for health professionals in doctrine is referred in detail. In our study, since the decisions of the Supreme Court of Appeals and the decisions of the Regional Court of Justice in our dissertation are final judgments, decisions of the regional court of justice are referred, the originality of our subject has been gained at many points by using the current sources and articles. It is aimed to find solutions to the problems by creating alternative solutions in order to put an end to the discussions and the problems experienced in the practice about the crime of not informing crime fort he members of the health profession.
