Le crime d'association de malfaiteurs à but terroriste

The crime of terrorist association, which is on the intersection of the organized criminality and terrorism, is one of the multidimensional crimes which becomes increasingly important in criminal law. The organized criminality and terrorism have a complex nature in criminal law as it is for other fields. While the organized criminality means primarily the whole crimes committed in the context of an association, doubtlessly, it includes association activities which is on the heart of the whole crimes. In this view, the crime and the fact of terrorist association, in the broader sense, is a part of the organized criminality. However, there is no consensus about the definition of the organized criminality. Like the organized criminality, the phenomenon of terrorism is known as a concept which is hardly defined in the national and international contexts. We come across with this difficulty in defining by laws the terrorist association and the acts which create the crime of terrorist association. In this context, as a type of crime, "The Crime of Terrorist Association in Turkish Criminal Law", should be independently analyzed from the aspect of criminal law. The method of analysis of a spesific crime in the field of criminal law-special provisions is generally used in this work named "The Crime of Terrorist Association in Turkish Criminal Law". In this context, important concepts for the crime, historical development, the criminological features of the crime, the patterns of regulation in the international documents and the national laws; the development and the patterns of regulation of the crime, the common and distinct points with similar crimes, the perpetrator, victim and legal scope of the crime, the elements of crime (the material element, the element of the contradiction to law and the moral element), its special features, sanctions and procedural provisions in Turkish law are examined.
