Abstract (EN)

PARSAK, Mehmet. Deprivation of Rights as a Security Measure in Turkish Penal Code, Master Thesis, Ankara, 2007.In this dissertation, which is titled as ?Deprivation of Rights as a Security Measure in Turkish Penal Code?, the security measures are evaluated within the framework of ?sanctions theory?. In this course, first the differences and similarities between sanctions and security measures are revealed; and then applicability of the security measure as itself or in association with the other criminal sanctions is investigated. Finally, an outline of the sanctioning system introduced by the New Turkish Penal Code is given. This is the basic composition of the dissertation. Following the explanation of the security measure concept, the definition of the security measure is given. We have explained that the security measures are regarded as criminal sanctions taking into account their legal qualities. Finally an evaluation of the correlation between the security measures and the general principles of the Criminal Law is made; and that concludes the overall explanations about security measures. In the final chapter ?deprivation of rights as a security measure ?is evaluated taking into account all the relevant aspects to it. In that context, first, the objective, implementation requisites and duration of the deprivation of rights as a security measure are identified. Then, each and every deprivation of rights as a security measure practice is thoroughly examined. Finally the special conditions in the new Penal Code are also reviewed as to the topic of the dissertation, and the results of the study are given including the Author?s recommendations and remarks.Key Words:1.
