Abstract (EN)

The most basic rights of human are their personal rights, then their political and social rights. The most valuable one among personal rights is the right to live. After the right to live, it is for the rights of body immunity and spiritual immunity under it. Crime definitions are regulated in their laws. These are sexual assault, sexual abuse, torture, torment and injury crimes. It is regulated in the law and is sanctioned. One of these crime definitions is sexual harassment. Among the definitions of crime that protect people's sexual immunity, the crime with the slightest injustice and sexual harassment is also one of the crime definitions that protect the right to spiritual immunity. Because there is no touch in sexual harassment. In other words, you are dealing with a sexual act of contact. So, it is committed by the act due to the nature of sexual harassment crime, and often with words spoken for sexual purposes without physical contact with the body. Sexual harassment other than talking; It can be formed by gestures such as gesturing, offering sexual intercourse. The study is of great importance in terms of identifying the current flaws of this crime in practice and theory, bringing new suggestions and opening the door to new case law.
