Abstract (EN)

The subject of this thesis is searching, copying and seizing information systems in Turkish criminal procedure law. These measures of protection are regulated in our law in the Criminal Procedure Code under the title of "Searching, copying and seizing computers, computer programs and files" and in the Council of Europe's Convention on Cybercrimes (Budapest Convention - the Council of Europe Convention on Cybercrimes) which we have ratified on 22 April 2014, under the title of "Search and seizure of stored computer data". This study aims to examine the related measures in the light of comparative law, practice, opinions in the doctrine and especially the decisions of the Court of Cassation. In the first chapter, the concepts of informatics, information system, computer program, computer file, data and electronic evidence have been explained and searching, copying and seizing information systems in comparative law are mentioned. In the second chapter, search searching, copying and seizing information systems in Turkish law are examined. In the conclusion part, the article of the law in force and the criticisms about its application are given. In addition, the article of the law has been rewritten in line with our criticisms.
