Exclusion of penalty from heritage according to Turkish law

The subject of our study, disinheritance, is regulated between articles 510 and 513 of the TMK numbered 4721. Removal from heirship is one of the legal actions that the legator can do in order to have consequences after his death. Thus, the legator removes the heirs with reserved shares, which are determined in a limited number in the law, from the inheritance completely or partially by complying with the necessary form conditions in the presence of certain reasons. There are two types of expulsion from inheritance, one being punitive removal and the other protective removal. Our study mainly consists of removing from heirship for criminal purposes, since it is often used in practice to remove from heirship for criminal purposes. Inheritance will be handled primarily as a concept with a general point of view, and in this context, the definition and elements of disinheritance, its comparison with similar concepts of inheritance law, and the place and application area of the provisions on disinheritance in Turkish Law will be emphasized. In the other parts of our study, the conditions of exclusion from heirship, the legal consequences of valid exclusion, the invalidity of exclusion from inheritance and the legal consequences connected to it, the legal problems that appear under these main headings and that are specific to exclusion from inheritance will be examined and the conclusions reached will be tried to be revealed.
