The concept of amnesty in Turkish law

The subject of the study is the amnesty institution, which has an important place in criminal law. Crime and punishments constitute the subject of criminal law. This leads to the formation of amnesty in crimes and penalties. In the first part of our study, we explained how amnesty was used in ancient civilizations, from the development of amnesty concept and historical process, how amnesty was developed in ancient Greece, Roman law, Germanic law and Europe. Information about amnesty characteristics and opinions about amnesty is given. In the second part of the study, we tried to focus on the legal nature of forgiveness and the concepts of authority. We explained the perspective of international law to amnesty. In Europe, we have provided information on which bodies are authorized to the amnesty institution in other countries. In the last part of the study, general amnesty, types of general amnesty, features of general amnesty and the results are given. As a result, it was observed that the institution of amnesty was always used in the historical process. When we look at the study in general, it is concluded that forgiveness should be used as little as possible. Because the amnesty institution usually moves away from its main purpose. Amnesty institution moves away from its original purpose by using it for political purposes. Amnesty should not be used for political purposes and should be used when society really needs it. In addition, the judicial body should be used rather than the legislative and executive body. If amnesty is in the judicial body, people who are and are not worthy of forgiveness can be separated in a healthier way.
