Abstract (EN)
The ever-changing economic structure and investment needs of the society have brought about the use of credit and the bank loan contracts that have emerged within this scope have become an integral part of the financial market as well as the social functioning and application of basic needs. In this study, firstly, because of the importance of the Loan Contracts mentioned before, the concept of bank was discussed together with banking activities, followed by explanation of lending institutions and types of loans. As one of the parties to the Loan Contract, the draft, as detailed in the content, is the basis for the loaner and contractual loan contract process as presented. The loan contract is a contract that lends debt to two parties, the debts of the bank and the customer are interconnected and in a change relation. Loan contracts can form the framework of different types of individual credit transactions and this leads to differences in implementation. However, these are not essential, fundamental differences. The loan contract is a commitment to grant a loan. In this case, the liabilities and obligations of the parties are prioritized. The parties, elements, liabilities, debts and obligations of the loan contracts were laid down together with their legal nature, and in the last part, the decisions of the Supreme Court of Appeals are given in order to shed light on the disputes concerning the loan contracts in practice.
