Abstract (EN)

The focus of this study is the temporary protection regime under Turkish law. In this context, initially the basic concepts of international protection law and the elements that provide the basis for the conceptualization of the temporary protection regime under international law are examined. Then, the temporary protection regime under Turkish law is elaborated upon. This elaboration includes the definition and scope of temporary protection, registration procedure for temporary protection, minimum protection standards provided by the temporary protection status and the termination of temporary protection. In terms of the minimum protection standards, the principle of non-refoulment, health and education services as well as the regulations on the access to labor market are explained. In addition, certain legal problems within the context of international private law which the persons enjoying temporary protection in Turkey might encounter, will be discussed. In terms of the termination of temporary protection, in addition to the procedure regarding the termination; the deportation of the persons benefiting from temporary protection are explained. Besides, durable solutions following the termination of temporary protection, namely repatriation, resettlement and local integration, are examined. This study, aims at investing temporary protection regime under Turkish law and bringing some suggestions to the legislator through identification of problems both in the drafting and the application of the relevant legislation.
