Abstract (EN)

In recent years, there has been an increase in the migration of foreigners to another country individually or collectively due to economic, political and cultural reasons. In order to protect against the negative effects of this increase, states feel the need to make regulations in their domestic laws. Because states have reserved authority to make regulations on this issue as a result of their sovereign rights. States establish regulations especially regarding entry into the country and the deportation of individuals who violate the public order and public security of the country. Because being meticulous about the entry of foreigners into the country and the deportation of foreigners who disrupt the country's order will largely eliminate the negative effects of migration movements. It is essential for foreigners to be held for certain periods during their entry into the country and deportation procedures. Because certain periods are needed for the completion of the foreigner's procedures. On the other hand, the possibility of the foreigner who has been decided to be deported to escape should be taken into consideration and his escape should be prevented until the decision is finalized. States ensure that foreigners are held until the entry into the country and deportation procedures are completed through administrative detention institutions. Administrative detention is a measure applied until the entry procedures of foreigners into the country or the deportation procedures of deported foreigners are completed. In this study, some basic issues regarding administrative detention will be discussed. Then, administrative detention of those with a deportation decision will be examined. Finally, explanations will be made about administrative detention during the international protection process.
