Person's right to information and functions in Turkish Law

In this study, the Turkish Law on Right to information Act and the Rights of the function are tried to be analyzed in parallel with the changes and developments experienced in public administration.October 9, 2003 on the Right to Information Act No. 4982, the Constitution of the Republic of Turkey 26, 40 and 74 Articles by Law No. 4709 in 2001 Amendments, the developments in public administration and the changes particularly within the framework of the EU harmonization process, are arranged legally in line with constitutional and legal arrangements.On September 12, 2010 a referendum will be put that the Constitution of the Republic of Turkey?s No. 5982 Amending Certain Articles of the Law is added ?The right to information" to the constitution?s law 74 and law 8. However, as the date of preparation of this thesis has not held on referendum yet and related law has not become the law is required to be specified.This right law is specified in the international legislation, United Nations (UN) Human Rights Universal Declaration (law 19), European Human Rights Convention (law 10), and the UN Civil and Political Rights Convention (law.19), the Administration of Protection against actions of the individuals' decision No. 31 (II) principle and it forms a basis which is adopted by Council of Europe Committee of Ministers in 1977.In the study, the right to information Act as a concept, definition, purpose, requirements and benefits are examined; the right to obtain information about the historical development of our country have been addressed. Also, the research is made on the narrow framework about developments in Europe especially in the example of France. In addition to this, the prevention on the efforts of right to information, the uses of information obtained from third parties are the subjects which are tried to be examined. Also, arrangements which were made during 1982 Constitution, the obligation to inform, an effort to obtain information, and the subject of the access to information and documents are studied in detail
