Abstract (EN)
The aim of this thesis is to analyze the legal responsibility of air carrier in case of death or bodily injury of passenger.This analyze is made under three main chapter. At the first chapter, the transport agreement (in general and air transport agreement made with passenger) and the international and national legal sources to be applied to the air transport agreement is revised. Under this chapter, the international legal sources are examined with chronological order including as well as the International Conventions and Protocols amended them than the Intercarrier Agreements made by the member of IATA.At the second chapter, the responsibility of air carrier regulated in international legal sources is examined. Under this chapter, the content, conditions and limits of air carrier?s responsability are analyzed. Furthermore, the unlimited responsibility and the possibility of exoneration is examined. All this explanation has been supported with the case laws.At the third and last chapter, the responsibility of air carrier under Turkish Civil Aviation Code is pointed out. All the explanation under Turkish Civil Aviation Code is made according to the legal sources in force.
