Business life is an area that various components such as employer and employee are engaged in order to make production of goods or services. To resume the function of the business life in a healthy way depends primarily on the provision of occupational health and safety. Health and safety of the workers are protected by measures taken within the framework of occupational health and safety. Failure to take these measures causes workers to be exposed to work accidents or occupational diseases. In case of death as a result of work accident or occupational disease, income is paid to the right holders by the work accident and occupational disease insurance in accordance with the relevant legislation. As a result of occupational accidents, besides the aids done by Social Security Institution, right holders may also benefit from "the compensation for loss of support". In order to request the compensation that is regulated within the scope of Article 53 of No. 6098 Turkish Code of Obligations, it is not required to have any legal or contractual duty of care between died employee and complainant. In case of an employee loses his or her life as a result of an occupational accident, some persons have been in lack of the support of that employee. These persons can request their damages from the employer who is responsible from the relevant occupational accident. However, persons in lack of the support of the employee can request compensation under some conditions. The compensation for loss of support is calculated due to some rules based on court practices.
