Abstract (EN)

There is no direct regulation in the Labor Law No. 4857 on working at home, which is the fulfillment of the worker's debt to work outside the employer's main workplace, at the worker's home or at another place to be determined. Working at home is regulated under the title of Home Service Contract in the Turkish Code of Obligations. Working at home, as the subject of the thesis, covers not the work done independently at home, but the work done for a fee, dependent on an employer. According to ILO's Home Work Convention, No.177 and Home Work Recommendation, No.184; homework means work carried out by a person, to be referred as a homeworker, doesn't have degree of autonomy and of economic independence necessary to be considered an independent worker under national laws, regulations or court decisions; in his or her home or in other premises of his or her choice, other than the main workplace, for remuneration, which results in a product or service as specified by the employer, irrespective of who provides the equipment, materials or other inputs used. Although flexible working practices are included in Turkish Labor Law, there are generally regulations for classical business relations. Since there is no direct regulation about working at home, in this thesis, it has been tried to reveal the situations that create difficulties in the practice of working at home among the regulations for the classical work relationship. As a result of the literatüre review on the working at home model, suggestions in labor law have been tried to be put forward.
