Abstract (EN)
Turkish Civil Code, in its art. 367 and following, charged the family chief with responsibility to organize order of a house in which members live as a family and granted him/her with authority and duties on this matter. Within the scope of these regulations, damages that caused by the family member which needs to be watched over shall be compansated by the family chief, in case he/she has not come up with an proof against negligence. In our thesis we explained absolute liability of family chief with its special and general conditions that cause this liability, and compensations that needs to be paid in case those conditions arise. While doing this we tried to study comprehensively by discussing supreme court decisions along with foreign court decisions and judicial opinions as possible.
