Alimony within the framework of the Turkish Civil Code and of the decisions Supreme Court

In this dissertation study titled "Alimony within the Framework of the Decisions of the Turkish Civil Code and Supreme Court", it has been examined how a person who is in a poor status can request for assistance from the blood relatives with a certain degree specified in the law irrespective of if they live together or separated. In the Turkish Civil Code, the maintenance types are divided into two as maintenance support and alimony. The maintenance support, on the other hand, consists of three titles as temporary alimony, alimony and child support. In this dissertation study; alimony, temporary alimony and child maintenances are touched upon if required, and the subject of alimony has been handled throughout the study. The alimony which is the subject of this study has been issued in the Articles 364, 365 and 366 of the Turkish Civil Code No. 4721. It is a moral duty to support whoever needs any help where the conditions of other individuals of the society are satisfied. Furthermore, the lawmaker has governed the liability of assistance which is a moral duty of the family member in a certain degree as legal obligations. Therefore, the alimony is a family institution which aims at helping the descendants, ascendants and siblings who fall into poverty if the person does not help, and which arranges the condition of the assistance. This study has been carried out in the light of the current provisions of law, applicable decisions of the Supreme Court and opinions and practices in the doctrine.
