Abstract (EN)

Amicus curiae, which is fundamentally an institution enabling third parties to submit opinions in judicial proceedings, has been shaped over time by judges as a procedural tool to meet the needs arising in the course of the adjudication process. Within the framework of this flexible use of the institution, the role of amicus curiae as an "advisor to the court", as understood in this study, may be rendered functional in Turkish civil procedure law as a mechanism capable of meeting the judge's need for legal information where necessary. Accordingly, this study aims to provide a detailed answer to the question of how the advisor to the court may be implemented within the Turkish legal system in pursuit of this objective.
