Abstract (EN)
In this thesis, subject ?ship arrestment in Turkish international procedural law? is studied. In this process, creditor?s right for ship, laws they are liable to, arrestment in Turkish international procedural law, problems steming from international law and arising in application, international aggrements, the last changes in legislation, current works about the subject, decisions of the Supreme Court of Appeals and the new Turkish Commercial Law Bill are studied. Firstly, in this thesis, the historical development of Admiralty Law is shortly mentioned. Then basic concepts about admiralty law like ship, ship?s register, running a ship are clarified. Subsequently, creditor?s right for ship and law cases that will be applied to this right are studied. In the second part of the thesis, applying foreclosure to ships and law matters that are to be applied are studied. After mentioning the basic problems in the foreclosure area. The law matter to which foreclosure is liable, is studied. Within this context, structures and features of international prosedural law is studied; then law to be applied, the matter of foreclosure for ships in other states and international aggrements about this subject are evaluated. In the last part of thesis, foreclosure in admiralty law, jurisdictional question, parties of prosecution, presentation, ships that are impossiple to arrest, arresting ships, matters of lien are studied. The thesis is limited about the ways of prosecution in arresting ships. Due to features of admiralty law, creditors will have lien; so they will prosecute mostly with the way of foreclosure. Accordingly, prosecution with the way of foreclosure is mainly studied in the thesis and meanwhile other ways of prosecution are explained.
