Abstract (EN)
There are benefits offered within the scope of the social security law to the insurance holders or right holders who suffered from occupational accident. The benefits are financed by the Social Security Institution. The expenses financed by the Institution are recoursed to the employer who is found to be responsible for the occupational accident or has not fulfilled the notification obligations. In the social security law, Articles 21, 23 and 76 of the Social Insurance and General Health Insurance Law No. 5510 constitute the legal basis for the responsibility of the employer. In this thesis, it is aimed to examine the responsibility of the employer in terms of occupational accidents from the point of Turkish social security law by making use of the Institution practice, relevant legislation, judicial decisions and, opinions in the doctrine.
