Abstract (EN)
The most fundamental feature of social insurance is the obligatory nature of insurance. Being covered by social insurance is not left to the will of the person. When certain circumstances are met, a legal relationship framed by the law will occur between the employer, the insured employee and the institution. However, when this situation, specifically called the principle of necessity is applied literally, those who cannot meet the requirements of compulsory insurance will not gain the right to be insured. At this point, employees who are unable to qualify for compulsory insurance via voluntary insurance defined as the exception of compulsory insurance and those who lose this right later on, are provided the right of being under cover of social insurance.In summary, this thesis attempts to investigate and explain voluntary insurance as stated in the 5510 numbered Social Security and General Health Insurance Law, previous implementations about the issue, adjudications and problems in implementation.
